What applications can I make from inside the UK?

Unless you are a British citizen, hold a certificate of entitlement or already possess some sort of immigration status in the UK.

Unless you have some sort of status already in the UK, you will need to apply for status either you enter the UK or on arrival in the UK. This depends which country you come from.

Once in the UK, circumstances may change and you may want to change/vary your stay or extend you existing stay in the UK.

1) Extension of Stay

Can I apply for to extend my stay?

This depends of the type of status you hold and how long you were granted leave to enter for when you arrived in the UK. For example, the maximum time you can spend in the UK on a work permit is five years. If you are granted leave to enter for less than this (usually for four years) you can apply for it to be extended to take you up to five years.

Check the other advice pages and the Immigration Rules for the rules on different types of status.

How do I apply to extend my stay?

You will need to apply to the Home Office, based in Croydon based on the correct form and the application will be usually considered by them, if the application is considered to be valid. If it is not valid or the relevant documents are not submitted with the application they will usually return the form back to you and will not keep a record of the application.

The application forms can be downloaded from the Immigration and Nationality Directorate website. You can instruct us to deal with the application and we would advise that you call our office to book an appointment.

From 1st August 2003 , the Home Office introduced fees and you will have to pay for the pays unless you fall to be within the exempt category. We can advise you of this when dealing with your application.

  • For a postal application the Home Office charge is £155. The Home Office says that it ‘should’ be able to return these within 13 weeks and, in 70% of cases, within 3 weeks. It is common for the Home Office to take longer and it also depends on the type of application submitted.
  • For a ‘premium’ service application, the Home Office charge is £250. This service is not available for all applications. You apply in person and get a decision the same day, if the application is complete and further enquiries are not necessary.

You can go to the Immigration and Nationality Directorate website for fees and guidance on the fees. The fees are the Home Office fees for the application only and it is not our legal fees.

2) Variation of Stay

Can I change/vary my status in the UK?

This is a difficult question to answer and it but it would be advisable to seek legal advice and to contact us. This is a complex area of law and is subject to frequent changes.

How much does it cost?

Yes. The same charges apply as for extension applications as set out office.

You can go to the Immigration and Nationality Directorate website for fees and guidance on the fees. The fees are the Home Office fees for the application only and it is not our legal fees.
